La fiscal separó esa venta en otra pieza para investigar el perjuicio causado a las arcas municipales. Sin embargo, esa pieza nunca se investigó pese a la enorme diferencia entre el precio al que vendió el Ayuntamiento (33 €/m2) y la plusvalía que obtuvo Balboa (1.080 €/m2) en escasos días.
